Excerpt: Arms embargoes fall within the sanctions or restrictive measures imposed by the European Union against third countries. In general, EU embargoes are either adopted to implement UN Security Council resolutions acting under Chapter VII, or are “autonomous.” In the latter case, embargoes are legally founded in a specific provision of the treaties establishing the European Union. EU members have full jurisdiction to decide on imposing arms trade restrictions. Prior to 1992, decisions on embargoes were made by the member states through an informal political process, the so-called European Political Cooperation. In several instances, member states convened as a body, the European Council, adopted declarations to impose embargoes. Within such a context, the embargo on China was imposed in 1989, by the then twelve members of the European Community, the EU’s precursor. The objective was to introduce arms trade restrictions against the regime in China in reaction to the killing of demonstrators in Tiananmen Square.
